Teilnahmebedingungen
Mit deiner Teilnahme an dem Gewinnspiel auf Luana Silva’s Blog unter www.luana-silva.com, erklärst du dich mit den nachstehenden Bedingungen einverstanden:
§ 1 Teilnahme
(1) Teilnahmeberechtigt sind ausschließlich volljährige Personen die Ihren Wohnsitz in Deutschland haben.
(2) Eine Person nimmt am Gewinnspiel teil, indem sie Ihre E-Mail adresse einträgt und dies an Luana Silva’s Blog abschickt. Bei mehreren Einsendungen entscheidet das Los.
(3) Es ist pro Teilnehmer nur eine Teilnahme in seinem eigenen Namen möglich.
(4) Der Teilnehmer ist für die Richtigkeit, insbesondere seiner E-Mail Adresse verantwortlich.
(5) Der Eingang der Email Eintragung hat innerhalb der im Gewinnspiel genannten Frist zu erfolgen. Zur Überprüfung der Fristwahrung dient der elektronisch protokollierte Eingang.
(6) Zur Teilnahme am Gewinnspiel ist unbedingt erforderlich, dass sämtliche Personenangaben der Wahrheit entsprechen, andernfalls erfolgt ein Ausschluss gemäß § 2 (3).
§ 2 Ausschluss vom Gewinnspiel
(1) Nahe Familienmitglieder und Mitarbeiter von Luana Silva’s Blog oder dessen Kooperationspartnern sind von der Teilnahme ausgeschlossen.
(2) Bei einem Verstoß gegen diese Teilnahmebedingungen behält sich Luana Silva’s Blog das Recht vor, Personen vom Gewinnspiel auszuschließen.
(3) Ausgeschlossen werden insbesondere Personen, die
– sich unerlaubter Hilfsmittel, wie z.B. einer automatisierten Registrierung bedienen,
– sich durch Manipulation Vorteile verschaffen,
– unwahre Personenangaben machen oder
– sich mehrfach zum selben Gewinnspiel anmelden.
In diesen Fällen kann der Gewinn auch nachträglich aberkannt und zurückgefordert werden
§ 3 Durchführung des Gewinnspiels
(1) Die Gewinner werden von Luana Silva’s Blog schriftlich per E-Mail benachrichtigt und können auf www.luana-silva.com und Instagram namentlich veröffentlicht werden. Mit dieser Form der Veröffentlichung erklärt sich der Gewinner ausdrücklich einverstanden.
(2) Meldet sich der Gewinner nicht innerhalb von 1 Woche nachdem Absenden der Benachrichtigung, so verfällt der Anspruch auf den Gewinn und es wird per Los ein neuer Gewinner ermittelt.
(3) Die Gewinne werden von Luana Silva’s Blog oder dessen Kooperationspartnern an die vom Gewinner anzugebende Postadresse versendet. Die Lieferung erfolgt innerhalb Deutschlands einmalig kostenfrei. Darüber hinaus anfallende Transportkosten und Zölle hat der Gewinner zu tragen.
(4) Ist die Übermittlung des Gewinnes nicht oder nur unter unzumutbaren Umständen möglich, so erhält der Gewinner einen gleichwertigen Ersatz.
(5) Eine Barauszahlung der Gewinne oder eines etwaigen Gewinnersatzes ist in keinem Falle möglich.
(6) Der Anspruch auf den Gewinn oder Gewinnersatz kann nicht abgetreten werden.
(7) Beschwerden, die sich auf die Durchführung des Gewinnspiels beziehen, sind unter Angabe des Gewinnspiels innerhalb von 14 Tagen nach Bekanntwerden des Grundes schriftlich an Luana Silva’s Blog zu richten. Fernmündlich mitgeteilte oder verspätete Beschwerden werden nicht bearbeitet.
§ 4 Vorzeitige Beendigung des Gewinnspiels
Luana Silva’s Blog behält sich ausdrücklich vor, das Gewinnspiel zu jedem Zeitpunkt ohne Vorankündigung und ohne Angabe von Gründen abzubrechen oder zu beenden. Von dieser Möglichkeit macht Luana Silva’s Blog insbesondere dann Gebrauch, wenn aus technischen Gründen (z. B. Viren im Computersystem, Manipulation oder Fehler in der Hard- und/ oder Software) oder aus rechtlichen Gründen eine ordnungsgemäße Durchführung des Gewinnspiels bzw. der Verlosung nicht gewährleistet werden kann.
§ 5 Datenschutz
(1) Luana Silva’s Blog verpflichtet sich, die gesetzlichen Bestimmungen zum Datenschutz zu beachten. Insbesondere wird in diesem Zusammenhang auf die Datenschutzbestimmungen verwiesen.
(2) Luana Silva’s Blog erhebt im Rahmen dieses Gewinnspiels personenbezogene Daten zur Durchführung des Gewinnspiels. Eine Weitergabe an Dritte, mit Ausnahme des Kooperationspartnern und der ausliefernden Transportunternehmen, ist ausgeschlossen! Luana Silva’s Blog kann die Daten für Marketing Zwecke nutzen.
§ 6 Sonstiges
(1) Bei Gewinnspielen auf Instagram gilt: Die Gewinnspiele stehen in keiner Verbindung zu Instagram und werden in keiner Weise von Instagram gesponsert, unterstützt oder organisiert. Der Empfänger der von den Teilnehmern bereitgestellten Informationen ist nicht Instagram, sondern die Luana Silva’s Blog als alleinige Veranstalterin. Sämtliche Fragen, Kommentare oder Beschwerden zu Gewinnspielen sind ausschließlich an Luana Silva’sBlog und nicht an Instagram zu richten.
(2) Der Rechtsweg ist ausgeschlossen.
(3) Es ist ausschließlich das Recht der Bundesrepublik Deutschland anwendbar. Bei Verbrauchern gilt diese Rechtswahl nur insoweit, als nicht der gewährte Schutz durch zwingende Bestimmungen des Rechts des Staates, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, entzogen wird.
(4) Sollten einzelne dieser Bestimmungen ungültig sein oder werden, bleibt die Gültigkeit der übrigen Nutzungsbedingungen hiervon unberührt.
(5) Diese Nutzungsbedingungen können jederzeit von Luana Silva’s Blog ohne gesonderte Benachrichtigung geändert werden.
Conditions of Entry
By taking part in the advent-prize draw on Luana Silva´s Blog at www.luana-silva.com you automatically agree to the following conditions:
§ 1 Participation
(1) Only natural persons who are of full age and have their place of residence in Germany are eligible.
(2) One person participates in the prize-draw by registering the e-mail address and sending it to Luana Silva´s Blog. Should more than one entry be submitted, the results will be decided by the drawing of lots.
(3) Each participant is only allowed to participate once for one door in his own name. It is not allowed to participate several times for the same door.
(4) The participant is responsible for the correctness, particularly of the e-mail address.
(5) The e-mail has to be registered in the time period which is mentioned in the prize draw. The electronically time-stamped receipt of registration for the prize draw serves to verify that entries were made before closing date.
(6) To participate in the prize-winning game, all personal data must be absolutely true and correct. Otherwise this could lead to an exclusion of the prize draw according to § 2 (3).
§ 2 Exclusion from the Prize Draw
(1) Family members and employees of Luana Silva´s Blog or its cooperation partners are prohibited from entering the prize draw.
(2) An infringement of these regulations can lead to exclusion from the prize draw.
(3) In particular, eligible for the prize draw are the following persons who
– make use of any other illegitimate means of help,
– seek advantage by means of manipulation,
– provide false personal information or
– participate several times for the same prize draw.
In such cases, winnings can subsequently be denied and reclaimed.
§ 3 Execution of the Prize Draw
(1) The winners will be notified in writing by Luana Silva´s Blog and can be published on www.luana-silva.com and on Instagram. The winner shall be deemed to have given his express consent to this form of publication.
(2) If the winner does not response within 2 weeks of this notification being sent, entitlement to the prize shall be forfeited, and a new winner shall be drawn per lots.
(3) The item won will be sent to the address given by the winner by Luana Silva´s Blog. Delivery takes place within Germany and is free of charge. Any additional transport costs and tariffs have to be paid by the winner.
(4) If delivery becomes impossible or is only possible under unreasonable circumstances, the winner will receive an equivalent substitute.
(5) Cash reimbursements of the prizes or a substitution of the prizes are not possible under any circumstances.
(6) Entitlement to the prize or any substitute prize cannot be assigned to others.
(7) Complaints regarding the way the competition has been run must be made in writing to Luana Silva´s Blog within fourteen (14) days from the date the reason for the complaint arose. Complaints made by telephone or after this period will not be dealt with.
§ 4 Premature Termination of the Prize Draw
Luana Silva’s Blog reserves the right to suspend the contest in full or in part at any time without giving reasons. Luana Silva´s Blog will make use of this option particularly if for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/ or software) or for legal reasons proper organization of the game cannot be guaranteed.
§ 5 Data Protection
(1) Luana Silva’s Blog undertakes to follow the legal regulations to the data protection. In this context reference is made in particular to the privacy policies.
(2) Luana Silva’s Blog is collecting and storing the personal data only for the purpose of running the prize draw. Disclosure to third parties is excluded with the exception of the cooperation partners and the delivering transport companies! Luana Silva’s Blog can use the email addresses for marketing purposes.
§ 6 Other
(1) The following condition applies for prize draws on Instagram: The prize draw bears no relationship to Instagram and was not sponsored, organized nor supported by Instagram in any way. The information of the participants are provided on behalf of Luana Silva´s Blog as the sole organizer and not to Instagram. Any questions, comments or complaints about the prize draw must be submitted exclusively to Luana Silva´s Blog and not to Instagram.
(2) The recourse to the courts is not permitted.
(3) The law of the Federal Republic of Germany shall apply exclusively. The foregoing provisions regarding the governing law apply to consumers only to the extent that granted protection is not withdrawed by compelling regulations of the right of the state, in which the consumer has his usual stay.
(4) If any parts of these terms are void or are becoming
void, this does not apply to the remaining parts which are remaining valid.
(5) The terms of conditions can be changed anytime by Luana Silva´s Blog.
